FactStream™ - Terms of Service

Agreement Summary:

This Terms of Service ("Agreement") is entered into by and between Tou Ci Ltd, a company incorporated under the laws of Hong Kong (SAR), with its principal place of business at [Address], and you ("User" or "you") for use of our data aggregation service, including our Application Programming Interface (API) and FactStream™ platform ("Service").

1. DEFINITIONS

• API: The FactStream™ API is a set of interfaces that allow Users to access the aggregated data through software applications.
• Data Aggregator: Tou Ci Ltd, which provides data aggregation services, including but not limited to, collecting, processing, and making available aggregated data through its API and FactStream™ platform.
• User Content: Any content or data provided by the User in conjunction with their use of the Service, including but not limited to, API keys, credentials, and any other information used to access the Service.
• Subscription: A paid service plan that allows Users to access additional features, higher data limits, or priority support.

2. USE OF THE SERVICE

By using our Service, you agree to comply with this Agreement, including but not limited to, all applicable laws and regulations in your jurisdiction.

Tou Ci Ltd reserves the right to modify, suspend, or terminate the Service at any time without prior notice.

You must be 18 years of age or older to use our Service.

3. USER ACCOUNT AND SECURITY

To access the API, you will need to create a User account by providing certain registration information ("Registration Data").

You are responsible for maintaining the confidentiality and security of your Registration Data.

Tou Ci Ltd reserves the right to terminate or suspend your access to the API if it reasonably believes that your account has been compromised.

4. SUBSCRIPTION AND PAYMENT TERMS

Subscription fees will be charged according to our current pricing schedule, which may change over time.

Payment for subscriptions must be made in advance through a payment gateway approved by us ("Payment Gateway").

All payments are non-refundable and non-transferable except as otherwise provided in this Agreement.

5. DATA USE AND OWNERSHIP

Tou Ci Ltd reserves all rights to the data it aggregates, including but not limited to, ownership, intellectual property rights, and proprietary information.

You may use the aggregated data solely for internal purposes related to your business operations ("Permitted Use").

Prohibited uses of the Service include, but are not limited to, using our data for commercial resale, creating derivative works, or sharing with third parties.

14. TERMINATION

Either party may terminate this Agreement upon written notice to the other.

Termination shall not affect any obligations accrued prior to termination.

By using our Service, you acknowledge that you have read and agree to be bound by the terms of this Agreement.
